The University Administrative Staff Union (ÜNİ-PER-SEN) has initiated legal proceedings regarding the assignments at Istanbul University Cerrahpaşa, stating that it is legally impossible for a worker-status staff member to be the superior of a civil servant.
In a statement made by ÜNİ-PER-SEN, it was noted that according to the Law No. 657 on Public Servants and relevant regulations, there is a hierarchical structure between civil servants, workers, and contracted personnel. “According to Law No. 657, there is a certain hierarchy between a civil servant and a superior. It is legally impossible for a worker-status staff member to be the superior of a civil servant. Workers subject to the Labor Law No. 4857 or contracted personnel must work under the management and responsibility of civil servants. It is unacceptable for these personnel to be assigned as superiors to civil servants. Such practices that undermine the principles of career and merit as stated in Law No. 657 reduce employee motivation and negatively affect institutional efficiency,” it was stated.

The statement emphasized that according to legal regulations, it is not possible for workers or contracted personnel to be appointed to civil servant positions temporarily. It was stated that the assignments are illegal and create unrest among employees. The following expressions were included in the statement:
“This lawsuit will not be limited to Istanbul University Cerrahpaşa, but will serve as a precedent in protecting the rights of public personnel working in all universities. As ÜNİ-PER-SEN, we will continue to defend the rights of our university staff and follow up on legal processes. We thank all our members who support our struggle. This case will be an important gain not only for university employees but also in protecting the rights of all public personnel.”
ÜNİ-PER-SEN stated that it will continue the struggle of university administrative personnel in every field, expressing that they will make their voices heard more strongly through field actions, consultations with university administrations, meetings with legislators and YÖK officials, and legal battles. The union indicated that they want to see university employees alongside them in this great struggle and invited them to join the union.
